Terms of Service

1. Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of the Groupick! mobile application (the “App”) operated by Jonathan Silverman (“Groupick!”, “we”, “us”, or “our”). By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

2. Eligibility

You must be at least 13 years old to use the App. By using Groupick!, you represent that you meet this age requirement and that you have the legal capacity to enter into these Terms.

3. Account Registration

You need an account to use the App. You agree to provide accurate information when registering, to keep your login credentials secure, and to notify us promptly if you believe your account has been compromised. You are responsible for all activity that occurs under your account.

4. Free and Pro Tiers

Groupick! offers a free tier and a paid “Pro” tier.

Free tier

• Up to 3 polls per calendar month
• Up to 5 members per poll
• Date Availability and Pick the Best poll types

Pro tier

• Unlimited polls
• Unlimited members per poll
• All poll types, including Rank Them
• AI-generated suggestions
• Saved groups and full poll history

Pro is offered at $4.99 per month or $39.99 per year. Pricing, limits, and features may change from time to time; any material changes will be communicated in advance.

5. Subscriptions and Billing

All Pro subscriptions are sold and managed through the Apple App Store using StoreKit. Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions renew automatically at the end of each period unless auto-renew is turned off at least 24 hours before the period ends. You can manage and cancel subscriptions in your Apple ID settings. Refunds are subject to Apple's refund policies.

6. User Content

You retain all ownership rights to the content you submit to the App, including poll titles, descriptions, suggestions, votes, availability selections, and uploaded images (“User Content”). By submitting User Content, you grant Groupick! a non-exclusive, worldwide, royalty-free license to host, store, reproduce, modify (for formatting), and display your User Content within the App as necessary to operate the service. This license ends when you delete the User Content, except where we are legally required to retain it or where retention is needed to preserve the experience of other participants in shared polls (see Section 9).

7. Acceptable Use

You agree not to use the App to:

• Harass, threaten, intimidate, or abuse other users
• Send spam, unsolicited messages, or advertising content
• Post content that is unlawful, infringing, obscene, or hateful
• Attempt to gain unauthorized access to the App or its systems
• Interfere with, disrupt, or reverse-engineer the App or its infrastructure
• Use the App for any illegal purpose

We may suspend or terminate accounts that violate these rules.

8. Reporting and Blocking

The App includes tools to report abusive content or users and to block other users. We review reports and take action we deem appropriate, including removing content or terminating accounts. Blocking a user prevents that user from contacting you or seeing your contributions in shared polls going forward.

9. Account Deletion

You may delete your account at any time from within the App. Deleting your account anonymizes your profile and deletes your authentication credentials. Aggregate poll history — including the outcomes of polls you participated in — may be preserved so that other participants' experience is not disrupted, but your identifiable information is removed.

10. Intellectual Property

The App, including its design, source code, trademarks, logos, and all non-user content, is owned by Groupick! or its licensors and is protected by United States and international intellectual property laws. These Terms do not grant you any right, title, or interest in the App other than a limited, personal, non-transferable, revocable license to use the App in accordance with these Terms.

11. Disclaimers

The App is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components. Your use of the App is at your sole risk.

12. Limitation of Liability

To the fullest extent permitted by law, Groupick! and its operator, Jonathan Silverman, will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill arising out of or in connection with your use of the App. Our aggregate liability for any claim arising out of these Terms or the App will not exceed the amount you paid us, if any, in the twelve months preceding the event giving rise to the claim.

13. Governing Law

These Terms are governed by the laws of the State of Indiana, United States, without regard to its conflict-of-laws principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Indiana for any dispute arising out of or relating to these Terms or the App, except that either party may seek injunctive relief in any court of competent jurisdiction.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the effective date at the top of this page. If the changes are material, we will provide additional notice within the App. Your continued use of the App after an update takes effect constitutes acceptance of the revised Terms.
